Robbery

     The felonious taking of personal property in possession of another person, from his or her person or immediate presence, and against his or her will, accomplished by means of force or fear. (Penal Code Section 211) 

     The feaar talked about can be either:

          (1) Fear of an unlawful injury to the person or property robbed or of any relative of that person or any member of that person's family;

          (2) Fear of any unlawful injury to the person or property of anyone in the company of the person robbed at the time of the robbery.

     Two Degrees of  Robbery:

          (1) First Degree Robbery: (a) Any person who is performing his or her duties as an operator of any bus, taxicab, cable car, street car, trackless trolley, or any other vehicle, including a vehicle operated on stationary rails or on a track or rail suspended in the air, and used for the transportation of persons for hire;

                                                     (b) Any passenger who is on one of these vehicles and any person who is in any inhabited dwelling house, a vessel which is inhabited and which is designed for habitation, an inhabitated floating home, a trailer coach which is inhabited, or the inhabited portion of any other building.

Punishment: 3, 4 or 6 years in teh State Prison. but, if the defendant is acting in concert with two or more other persons the punishment is 3, 6 or 9 years in teh State Prison.

           (2) Second Degree Robbery: Anything other than what is listed in (a) & (b) above.

Punishment: 2, 3, or 5 years in the State Prison.
